Department of Labor Resumes Processing for Temporary and Permanent Employment Applications |

The Department of Labor (DOL) announced that it has resumed processing applications for prevailing wage determinations, labor condition applications (LCAs), and PERM, H-2A and H-2B labor certifications. The Foreign Labor Application Gateway (FLAG) system is also accessible and can now be used to submit new applications.
DOL hasn’t issued guidance for the late filing of PERM applications. In the past, they’ve provided a grace period, and hopefully they will do the same now. We will provide an update when it becomes available.

DHS Terminates Automatic Extensions for Employment Authorization Documents |
|
USCIS announced that it will no longer automatically extend an individual’s employment authorization document (EAD) after an application for renewal is filed.
The interim final rule by the Department of Homeland Security explains that this change is meant to increase screening and vetting for foreign nationals living and working in the United States. Those submitting EAD renewal applications will now undergo additional security screening before their extension is approved.
The rule is effective October 30, 2025, and will not apply to any EAD extensions filed before this date. USCIS emphasized the importance of filing a timely EAD renewal (within 180 days of its expiration) to avoid a temporary break in a person’s ability to work within the United States.

Note: This rule does not apply to STEM OPT EAD extensions. STEM OPT extension applications (timely filed) will automatically extend EADs for 180 days. |
